These terms govern your use of BrightJobs. Please read them before you sign up.
1. Who these terms are with
BrightJobs is provided by James Thomas trading as Bright Future Business Solutions (Sole trader established in the United Kingdom), of 10 Oleander Drive, Southampton, SO40 8XX, United Kingdom. VAT registration number 412818608. In these terms “we”, “us” and “our” mean Bright Future Business Solutions, and “you” means the business that holds the BrightJobs account.
BrightJobs is sold to businesses only. It is not offered to consumers, so consumer cancellation rights do not apply.
2. The service
BrightJobs is an online job management service for small service businesses. It lets you record customers and staff, create and send quotes, schedule and complete jobs, attach photographs and notes, send branded job reports to your customers, raise invoices, and record payments.
You are responsible for the accuracy of everything you enter, for the work you carry out for your own customers, and for the invoices and reports you issue through the service. BrightJobs is a tool that presents your information; we are not a party to any contract between you and your own customers.
3. Charges and payment
The published BrightJobs charges are:

All prices are shown excluding VAT and then including VAT at the current UK standard rate of 20%. A VAT invoice is generated automatically for each successful payment and emailed to you.
The optional .co.uk domain currently costs £13.00 + VAT (£15.60) for the first year, with renewal currently £13.00 + VAT (£15.60) per year. Domain renewal prices are not fixed permanently and may change in future, for example if registry or registrar costs change. We will give you reasonable advance notice by email before any changed renewal price is charged, and you may choose not to renew.
4. Price changes
We may change BrightJobs prices in the future. If we change the recurring subscription price that applies to your account, we will give you at least 30 days’ notice by email before the new price takes effect.
If you do not wish to continue at the new price, you may cancel before it takes effect.
Domain renewal prices may also change. We will give you reasonable advance notice by email before a changed domain renewal price is charged, and you may choose not to renew the domain.
5. Term, cancellation and refunds
BrightJobs is a monthly business subscription with no long-term minimum contract. You can cancel at any time from the Subscription page inside your BrightJobs account, or by contacting us at info@brightfbs.co.uk. Cancelling stops future recurring Direct Debit collections.
Your access continues until the end of any subscription period you have already paid for. Part-used subscription periods are not normally refunded, except where the law requires it or where we agree otherwise.
Cancelling the Direct Debit with your bank on its own does not close your BrightJobs account. Where notification is needed to close the account, please tell us as well, so we can stop the service and handle your data correctly.
The one-off setup and activation fee of £99.00 plus VAT is non-refundable once account setup and provisioning has commenced, except where the law requires otherwise or where we agree otherwise.
A .co.uk domain that has already been registered or renewed for you is also non-refundable, because the third-party registration cost has already been incurred.
6. Your account and users
You are responsible for keeping sign-in details secure and for the actions of every user you add to your account. You must tell us promptly if you believe an account has been compromised. Staff-level users cannot change pricing, VAT settings or payment status; owner and manager users can.
7. Acceptable use
You must not use BrightJobs to store or send unlawful, abusive or infringing content, to attempt to access another business’s data, to disrupt or probe the service, or to resell the service without our written agreement.
8. Your data
You keep ownership of the information you put into BrightJobs. We process personal data in your account on your instructions, as set out in our Data Processing Terms, and we handle personal data we hold about you as controller as set out in our Privacy Policy.
9. Payments taken from your own customers
If you choose to enable card payments, they are processed through your own Stripe Connect account under Stripe’s terms, and funds are paid to you by Stripe. BrightJobs does not currently take any platform fee on those transactions. If you instead show your bank details for transfer, you are responsible for checking that payment has been received before marking a job as paid.
10. Availability and support
We will use reasonable care and skill to keep BrightJobs available and operational, but we do not guarantee uninterrupted or 100% uptime. Temporary interruptions may happen because of maintenance, upgrades, third-party service failures, internet or network problems, security work, or circumstances outside our reasonable control.

These hours are support availability hours only. They are not guaranteed response or resolution times. Unless a response time is expressly stated in the BrightJobs service, no guaranteed response or resolution time forms part of these terms.
11. Liability
BrightJobs is supplied for business use only, and nothing in this section limits liability that cannot lawfully be limited or excluded. In particular, we do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
BrightJobs is a tool for recording and presenting your own business information. You remain responsible for checking your jobs, quotes, prices, VAT and tax treatment, customer information, reports, invoices and business records, and for keeping any records you are legally required to keep. We do not provide accounting, tax or legal advice.
Subject to the paragraph above, we are not liable to you for loss of profit, loss of business, loss of anticipated savings, loss of goodwill, or any indirect or consequential loss, and we are not liable for any loss arising from your failure to keep your own independent records or from inaccurate information you enter into the service.
Subject to the first paragraph of this section, our total liability to you in connection with the BrightJobs service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited in aggregate to the total charges you paid to us for the service in the 12 months immediately before the event giving rise to the claim.
12. Suspension and termination by us
We may suspend or restrict your account where reasonably necessary because of overdue or non-payment, material breach of these terms, unlawful or abusive use, attempted unauthorised access, security threats, or misuse that puts the platform or other users at risk, or where continuing to provide the service would expose us or another party to legal or security risk.
We will give you reasonable notice where it is practicable to do so, but we may suspend immediately where urgent action is reasonably necessary for security, fraud prevention or legal reasons. We will restore access once the issue is resolved, and we may end the agreement where the issue is not put right.
13. Changes to these terms
Each published version of these terms carries a version number and effective date. The version you accepted at signup is recorded against your account.
Where we make a material change to these terms, we will give existing customers at least 30 days’ notice by email before the new version applies. If a change also affects your recurring subscription price, the price notice in section 4 applies as well, and you may cancel before the change takes effect.
14. Governing law
These terms and any dispute or claim arising out of them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. This is subject to any mandatory legal rights or protections that cannot lawfully be excluded.
